By using SmartSite Studios services or our website, you agree to these Terms of Service ("Terms"). Please read them carefully.
SmartSite Studios provides AI receptionist services, review management, lead tracking, automation tools, and related services for local service businesses. Specific services and deliverables are outlined in your individual Service Agreement.
Plans are offered at the following tiers, each available with monthly or annual billing. Annual billing is discounted approximately 20% and carries no setup fee.
The AI Receptionist plan is $99 per month, or $950 per year, with no setup fee on either billing period. It includes a 24/7 English-language AI receptionist and instant lead alerts by email and SMS, limited to 100 answered calls per calendar month; it does not include review automation, the lead capture form, or dashboard access. Calls beyond the monthly limit may be subject to additional charges or may not be answered, and we will make reasonable efforts to notify you as you approach the limit. A bilingual (English and Spanish) receptionist option is available on this plan for an additional $25 per month; because that option bills monthly, it can only be added to monthly AI Receptionist subscriptions.
The Starter plan is $249 per month plus a one-time setup fee of $197, or $2,390 per year with no setup fee. The Pro plan is $497 per month plus a one-time setup fee of $597, or $4,770 per year with no setup fee. Both include unlimited answered calls with no monthly call limit, subject to the fair-use and acceptable-use provisions of these Terms.
Annual plans are billed in full at the start of each yearly term. Setup fees, where applicable, are charged once at signup and are non-refundable. Prices are those displayed at the time of purchase; changes to our published pricing do not alter the rate on an existing subscription for its current term.
Review automation, included with the Starter and Pro plans, requires an active Google Business Profile owned and controlled by you. That profile is where review requests direct your customers. We do not create, claim, verify, or manage Google Business Profiles, and review automation cannot function without one.
Our review requests are sent to every customer for whom you mark a job complete, and the public review link is provided to every customer who responds, regardless of the rating they give. We do not screen, filter, suppress, gate, or condition access to the public review option based on a customer's sentiment. Where a customer indicates dissatisfaction, we may additionally invite them to share feedback privately with you; that invitation is offered in addition to the public review link and never as a substitute for it. You agree not to ask us to configure the service in any manner inconsistent with this paragraph.
Custom website design and hosting is available as a separate paid add-on to an active plan, not as part of a standard plan.
You must be at least 18 years old and authorized to enter into binding contracts on behalf of any business you represent.
You are responsible for maintaining the security of your account credentials, including passwords for the dashboard and client portal. Notify us immediately of any unauthorized use.
Fees are outlined in your Service Agreement. The $200 signing fee is non-refundable. Monthly fees, when applicable, are billed in advance. Failure to pay may result in service suspension after 7 days notice.
You agree not to use our services to:
You retain ownership of content you provide (logos, photos, copy). SmartSite retains ownership of underlying systems, code, and infrastructure used to deliver services. You receive a license to use deliverables for your business while a paying client.
Our AI receptionist services are automated and may make errors. You acknowledge that:
We aim for high uptime but do not guarantee 100% availability. Services may be interrupted by maintenance, third-party outages, or events beyond our control. We are not liable for losses due to downtime.
Our services rely on third-party providers (Twilio, VAPI, Cal.com, Supabase, Netlify, etc.). Their availability and pricing affect ours. We are not responsible for changes or outages of third-party services.
To the maximum extent permitted by law, SmartSite's total liability for any claim is limited to the fees you paid in the 30 days preceding the claim, or $200, whichever is greater. We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, lost customers, or business opportunities.
You agree to indemnify and hold SmartSite harmless from claims arising from your misuse of services, violation of these Terms, or content you provide.
Either party may terminate the Service Agreement with 30 days written notice. SmartSite may suspend or terminate immediately for non-payment, abuse, or violation of these Terms.
We may update these Terms periodically. Continued use after updates constitutes acceptance. Material changes will be communicated via email.
These Terms are governed by the laws of California. Disputes will be resolved through binding arbitration in Santa Clara County, California.
